One of the most common questions I am asked is:

When do I need a family lawyer?

Nobody wants to spend extra money on legal bills. This is money that could be spent on you and your family. So if you’re getting a divorce or separating, you may find yourself asking, do I need a lawyer at all?

Well, the short answer is no, you don’t need a lawyer, but you may end up with much less than you’re entitled to.

There is no requirement that you have legal representation in a divorce. However, generally speaking, if you want to enter into a binding financial agreement or consent orders with your spouse, each of you needs to receive independent legal advice. There can be a temptation to ‘keep the lawyers out of it’, which is perfectly reasonable, but the risk is that any agreement you reach may be set aside if it does not meet the requirements under the law, even if you both agree on the property settlement. This means that your spouse may be able to turn around and take you to Court anyway, which is obviously the last thing you want.
